Terms of Service

1. Acceptance

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Definitions

• Service — the GoTEM AI Planner web/iOS/Android/PWA application
• Member — a natural person who has accepted these Terms and registered
• Pro Subscription — paid plan unlocking all features (₩14,900/month or ₩153,000/year)
• Pro Trial — 7-day complimentary access to Pro features for new accounts
• Four-axis data — daily sleep, exercise, diet, and mood scores
• Block — a scheduled task/event item
• Golden Time — the AI-computed daily peak focus window

3. Account & Eligibility

• You must be at least 14 years old to register.
• Members under 19 (Korean age of majority) require parental consent for paid purchases.
• You must provide accurate information and keep your credentials secure.
• We may decline or terminate accounts that violate these Terms or applicable laws.

4. Services Provided

• Daily GoTEM AI analysis (powered by Google Gemini 2.0 Flash)
• Automatic Golden Time computation and block placement
• Four-axis daily scoring and trend analytics
• Weekly pattern reports (Sundays 09:00 KST)
• "I MADE IT" personalized encouragement
• Optional BrainyCards data sync
• Other features added by BrainyLabs from time to time

5. Pro Subscription & Billing

5.1 Trial

• 7-day free trial begins on signup.
• Notifications sent 6/3/1 days before and on the day trial ends.
• If you do not subscribe, the account converts to Free at trial end.

5.2 Pricing

• Monthly: ₩14,900 (VAT included)
• Annual: ₩153,000 (~14% savings)

• Web: Toss Payments (card, bank transfer)
• iOS: Apple In-App Purchase
• Android: Google Play Billing
• Unified state: RevenueCat

6. Refunds

See the dedicated Refund Policy. Summary:

• Web (Toss): 100% refund within 7 days if not used (per Korean E-commerce Act Art. 17)
• iOS: handled by Apple per Apple's refund policy
• Android: handled by Google Play (auto-refund within 48 hours of first purchase)

7. User Obligations

You agree not to:

• Register with false information or impersonate others
• Infringe intellectual property of BrainyLabs or third parties
• Engage in defamation, harassment, or unlawful content posting
• Reverse-engineer, scrape, or automate access to the Service
• Resell or sublicense the Service without prior written consent
• Otherwise violate these Terms or applicable laws

8. Disclaimers & Limitation of Liability

To the maximum extent permitted by law, BrainyLabs is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim, except for damages caused by our willful misconduct or gross negligence.

9. Intellectual Property

• Service software, designs, logos, and content are owned by BrainyLabs or its licensors.
• You retain ownership of content you create within the Service.
• You grant BrainyLabs a non-exclusive, royalty-free license to use anonymized content for service operation, improvement, and promotion.

10. Service Changes & Termination

We may modify, suspend, or discontinue the Service (or any part) with reasonable notice. If we terminate a paid subscription without cause, we will refund the pro-rated unused portion.

11. Account Termination by Member

You may delete your account at any time via in-app [Settings → Account → Delete] or by emailing cs@brainylabs.kr. Deletion is immediate and irreversible.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Korea. Exclusive jurisdiction shall be the Seoul Central District Court. EU residents retain their right to bring claims in their home country courts under GDPR.

13. Changes to Terms

We will give at least 7 days' notice (30 days for adverse changes) before any modification takes effect. Continued use after the effective date constitutes acceptance.
